What you agree to when you use Fenfair to run your handmade business.

Acceptance

Acceptance.

By signing up for or using Fenfair, you agree to these Terms of Service and the Privacy Policy at /privacy. If you do not agree, do not use Fenfair. If you are using Fenfair on behalf of an organization, you confirm you have authority to bind that organization.

Who can use Fenfair

Eligibility.

Fenfair is offered to handmade and craft sellers operating a real business. You must be at least 18 years old and able to enter binding contracts under the laws of your jurisdiction. Fenfair is not directed at children under 16.

Your account

Account responsibility.

You are responsible for keeping your sign-in credentials secret and for all activity that occurs under your account. Notify us immediately at security@fenfair.com if you suspect unauthorized access.

Free build mode vs paid Fenfair Core

Free build mode and paid access.

Fenfair offers a free build mode that lets you draft a storefront, products, and brand artifacts. Paid features (publishing your shop publicly, accepting buyer payments, custom domain configuration, real marketing sends, production-tier AI use) require an active Fenfair Core subscription. A 14-day free trial of Fenfair Core begins only after you explicitly start the trial, add a payment method, and consent to renewal terms.

Fees and billing

Subscription fees.

Fenfair Core is currently priced at $37/month or $370/year (subject to change with 30 days notice to existing subscribers; existing subscribers are billed at their grandfathered rate for the duration of their current period). Fees are billed in advance and are non-refundable except where required by law. Payments are processed by Stripe. You authorize Fenfair to charge your saved payment method on each renewal date until you cancel.

Stripe Connect

Payment processing.

To accept payments from your buyers, you must onboard with Stripe Connect through Fenfair. By doing so you agree to Stripe Connect terms which apply to your relationship with Stripe. Fenfair acts as a platform; payment disputes, chargebacks, and tax obligations to your buyers are between you and Stripe (and ultimately you and your buyer). Fenfair does not assess transaction fees beyond Stripe's processing fees.

Acceptable use

Platform rules.

You agree to comply with our Acceptable Use Policy at /aup. Briefly: no illegal goods, no infringement of third-party intellectual property, no fraud, no spam, no AI-generated listings or images you cannot truthfully claim as your own handmade work, no automated abuse of platform resources. Violations may result in suspension or termination without refund.

Your content, your IP

Seller content ownership.

You retain all intellectual property rights in content you upload to Fenfair (product photos, descriptions, brand assets, etc.). You grant Fenfair a non-exclusive, worldwide, royalty-free license to host, display, and process this content for the purposes of providing the service to you and your buyers. This license ends when you delete the content or close your account, except where retention is required by law or for backup.

AI features

AI-assisted setup tools.

Fenfair offers AI-assisted setup tools (storefront drafts, brand suggestions, product description starters, etc.). These tools are aids, not replacements for your judgment. You are solely responsible for reviewing and editing AI-generated content before publishing or sending to buyers. Fenfair does not warrant the accuracy, suitability, or originality of AI-generated content. See /ai-use for our complete AI use policy.

Logos and brand kits generated through Fenfair's AI tools are assigned to you, the seller, when you publish your storefront. Fenfair retains a license to display these assets on your Fenfair storefront for the duration of your subscription. You are responsible for clearance and trademark searches before using any logo at scale; Fenfair does not warrant non-infringement of third-party marks.

Service availability

Availability and interruptions.

Fenfair aims for high availability but does not guarantee uninterrupted service. Status is published at /status/public. Scheduled maintenance is announced in advance. Unscheduled outages are remediated as quickly as possible. Fenfair is not liable for losses arising from service interruptions beyond a refund of pro-rated fees for the period of unavailability.

Termination

Cancellation and account closure.

You may cancel at any time from /settings/account. Cancellation takes effect at the end of your current billing period. Fenfair may suspend or terminate accounts that violate these terms or our Acceptable Use Policy. Upon termination, your published storefront stops serving requests; you have 30 days to download your data before hard purge.

Limitation of liability

Liability cap.

To the maximum extent permitted by law, Fenfair's total liability under these Terms is limited to fees you paid in the 12 months preceding the event giving rise to liability. Fenfair is not liable for lost profits, lost data, or consequential damages. Nothing in this section limits liability for gross negligence, willful misconduct, or any matter for which liability cannot be excluded by law.

Indemnification

Third-party claims.

You agree to indemnify Fenfair against third-party claims arising from your use of the service, content you publish, products you sell, or violations of these terms. Fenfair indemnifies you against claims that your authorized use of the Fenfair platform infringes third-party intellectual property, provided you promptly notify us and cooperate in defense.

Binding arbitration and class action waiver

Dispute process.

Disputes arising under these Terms (other than claims for intellectual property, equitable relief, or small-claims-court matters) will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You waive any right to participate in a class action against Fenfair. If you are a consumer resident in a jurisdiction where mandatory class waivers are unenforceable, this section applies only to the extent permitted by law.

Governing law

Kansas law.

These Terms are governed by the laws of the State of Kansas, USA, without regard to conflict of laws principles. The exclusive venue for any judicial proceeding (where not subject to arbitration) is the state and federal courts located in Wyandotte County, Kansas.

Changes to these Terms

Term updates.

We will post material changes to this page at least 30 days before they take effect, and notify active sellers by email. Continued use after the effective date constitutes acceptance. Last updated: 2026-06-09.
